Temporary Protective Order
Domestic Violence Protective Order
To qualify for a Domestic Violence Protective Order there is a specific criteria that must be met.
NRS 33.018 Acts that Constitute Domestic Violence
1 Domestic violence occurs when a person commits one of the following acts against or upon his spouse, former spouse, any other person with whom he is related by blood or marriage, a person with whom he is or was actually residing, a person with whom he has had or is having a dating relationship, person with whom he has a child in common, the minor child of any of those persons, his minor child or any person who has been appointed the custodian or legal guardian for his minor child; (a) A battery;(b) An assault; (c) Compelling the other by force or threat of force to perform an act form which he has the right to refrain or to refrain from an act which he has the rights to perform; (d) A sexual assault; (e) A knowing, purposeful or reckless course of conduct intended to harass the other; (f) A false imprisonment; (g) Unlawful entry of the other's residence, or forcible entry against the other's will of there is a reasonably foreseeable risk of harm to the other from the entry.
Application for Temporary Order against Domestic Violence must include a Confidential Worksheet.
Stalking and Harassment Protective Order
Justice Courts have jurisdiction to issue Protection Orders against Stalking and Harassment.
If you believe you are being harassed or stalked by another individual, and both parties are 18 years of age or older, you may file a Standard Application for Temporary Protection Order against Stalking and Harassment with the court.
If a minor is experiencing harassment and the adverse party is over the age of 18, the minor's parent/guardian must complete the application on behalf of the minor child and against the adverse party.
Application for Temporary Order against Stalking and Harassment, must include a Confidential Worksheet.
If you desire to dissolve, extend or modify an existing Temporary Protective Order, you will need to complete a Motion to Dissolve, Extend or Modify Temporary Protection Order.
